Cape Consulting & Companies LLC (CAPE) operates www.thecapeconsulting.com and provides professional Shopify services. We are responsible for the personal information we use to run our business and serve our customers. Information we process
Depending on your interaction with us, we process contact and billing details; order, payment confirmation, SEED balance and refund records; support messages and files you send; project briefs and information needed for an agreed task; and technical information such as IP address, browser, device and website activity. Payment providers process payment credentials through checkout. Please do not send full payment card details, passwords or unnecessary customer data in messages.
Why we use it
We use this information to answer enquiries, take payments, record and manage credits, quote and deliver approved work, communicate about orders and tasks, handle refunds, maintain records, prevent fraud and keep our services secure. Where relevant, the legal basis is performing a contract or taking steps at your request before a contract, complying with legal obligations, our legitimate interests in running and protecting our business, or your consent where required. You may withdraw consent without affecting processing that was lawful before withdrawal.
Shopify and checkout
Our store is hosted by Shopify. Information you provide and information about your use of the store is shared with Shopify and relevant payment providers to operate the website, process orders and provide checkout. Shopify may also process information from your interactions with our store, other merchants and Shopify to provide its enhanced services, in accordance with its own privacy notices and the relevant store settings. Support chat and cookies
We use Crisp for website chat and customer support. Chat messages, details and files you provide, conversation history, technical data such as IP address and device information, and website context may be processed to operate chat and help us answer you. Crisp and Shopify use cookies or similar technologies to support their services. See Crisp’s Privacy Statement and Cookie Policy for details. You can manage cookies through your browser and any privacy controls presented on our website. Disabling necessary cookies can affect checkout or chat. You can contact us by email if you prefer.
Who receives information
Information is available to the CAPE team members and service providers who need it for the purposes described here, including Shopify, payment providers and Crisp. We may also disclose information where required by law, to handle a legal claim or to protect against fraud or security incidents. External websites linked from our site have their own privacy practices.
Project and store access
Where an approved task requires access to your Shopify store or business information, we agree the access needed for that task. If work involves processing your customers’ personal information on your behalf, the relevant scope and data protection arrangements must be agreed before that processing begins.
International processing
Our team operates in the United States and Europe, and our providers may process information in other countries. Data protection rules can differ between countries. Where applicable law requires safeguards for an international transfer, those safeguards must apply to the relevant processing.
Security and retention
We use access restrictions and appropriate safeguards for the information handled in our work. No internet service can guarantee absolute security. We keep information for as long as needed to provide services, maintain necessary transaction and tax records, meet legal obligations and resolve disputes. Retention depends on the type of record and the purpose for holding it.
Your rights and choices
Depending on where you live and the applicable law, you may have rights to access, correct, delete or receive a copy of your information, restrict or object to processing, withdraw consent, and opt out of certain advertising-related processing or sale or sharing as those terms are defined by law. Email david@thecapeconsulting.com to make a request or ask about the processing relevant to you. We may need to verify your identity. You can also use Shopify’s privacy portal for requests concerning Shopify’s own processing. You may complain to the relevant data protection authority and exercise any applicable appeal rights. We will not discriminate against you for exercising your rights.
Children and updates
Our services are intended for business users, not children. If you believe a child has provided us with personal information, contact us. We will update this policy when our practices change and provide any notice required by law.
